Personal, Non-commercial and Lawful Use of this Web site 
Travelovista grants you a limited, non-transferable license to use this site in accordance with the terms and conditions of this Terms of Service. Unauthorized use of this site and/or the materials contained on this site may violate applicable copyright, trademark or other intellectual property laws or other laws. You must retain all copyright and trademark notices, including any other proprietary notices, contained in the materials, and you must not alter, obscure or obliterate any of such notices. Use of Travel Reservation Facilities
You agree that the travel reservation facilities of this Web site shall be used only to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act, and you shall not use the travel reservations facilities for any other purposes, including without limitation, to make any speculative, false or fraudulent reservation or any reservation in anticipation of demand.

Separate terms and conditions, imposed either by Travelovista, its agents and/or service partners may apply to your reservation and purchase, and cancellation of travel-related goods and services that you select and maybe subject to a minimum 20% cancellation fee to cover our processing charges. You agree to abide by the terms or conditions of purchase/cancellation imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with all rules and restrictions regarding availability of fares, products, or services. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of this Web site.

Age and Responsibility
You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and to use this Web site in accordance with all terms and conditions herein. You agree to be financially responsible for all uses of this Web site by you (as well as for use of your account by others, including without limitation minors living with you). You agree to supervise all usage by minors of this Web site under your name or account. 

Your Registration Obligations
In consideration of your use of the Service, you agree to 
(a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration, and

If you provide any information that is untrue, inaccurate, not current or incomplete, or Travelovista has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Travelovista has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof). Travelovista also reserves the right to cancel confirmed bookings and charge you cancelation and/or processing charges as it deems fit.

Privacy Policy
Registration, and certain other information about you, is subject to our Privacy Policy. For more information, please read our Privacy Policy. You hereby consent to the use of your personal information by Travelovista and/or its third party providers and distributors in accordance with the terms of and for the purposes set forth in the Travelovista Privacy Policy.

Login Information and Security
You shall choose a Login Name and Password while completing the Service's registration process. You are responsible for maintaining the confidentiality of the Login Name and Password, and are fully responsible for all activities that occur under your Login Name or Password. You agree to:
(a) not divulge your Login Name or Password to any other person,
(b) immediately notify Travelovista of any unauthorized use of your Login Name or Password or any other breach of security, and
(c) ensure that you exit from your account at the end of each session. Travelovista cannot and will not be liable for any loss or damage arising from your failure to comply
with this Section.

General Practices Regarding Use and Storage
You acknowledge that Travelovista may establish general practices and limits concerning use of the Service, including without limitation the maximum number of days that, message board postings or whether the Service will retain uploaded Content. You agree that Travelovista has no responsibility or liability for the deletion or failure to store any information, messages and other communications, or other Content maintained or transmitted by the Service. You acknowledge that Travelovista reserves the right to log off accounts that are inactive for an extended period of time. You further acknowledge that Travelovista reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.

Termination
You agree that Travelovista, in its sole discretion, may terminate your account (or any part thereof) or use of the Service, and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if Travelovista believes that you have violated or acted inconsistently with the letter or spirit of the Terms of Service. Travelovista may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of these Terms of Service may be effected without prior notice, and acknowledge and agree that Travelovista may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that Travelovista shall not be liable to you or any third-party for any termination of your access to the Service.

You agree that Travelovista shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

Content submitted or made available for inclusion on the Service
Travelovista does not claim ownership of Content you submit or make available to us for inclusion on the Service. However, with respect to Content you submit or make available to us, you grant Travelovista the world-wide, royalty free and non-exclusive license(s) to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content (in whole or in part) on the Service, and/or to incorporate such Content into other works in any format or medium now known or later developed.
 

Use of Bulletin Board, Chat Room, and Other Communications Forums If this Web site contains bulletin boards, chat rooms, or other message or communication facilities (collectively "Forums"), you agree to use the Forums only to send and receive messages and material that are proper and related to the particular Forum. You agree that Travelovista shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

Entire Agreement and Jurisdiction
The Terms of Service constitute the entire agreement between you and Travelovista with respect to this Web site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Travelovista, with respect to this Web site. The Terms of Service and the relationship between you and Travelovista shall be governed by the laws of India. You hereby consent to the exclusive jurisdiction and venue of courts in Jaipur, in the State of Rajasthan, India, in all disputes arising out of or relating to the use of this Web site. Use of this Web site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Travelovista as a result of this agreement or use of this Web site.

The failure of Travelovista to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. If any part of this Terms of Service is found by a court of competent jurisdiction to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms of Service must be filed within one (1) year after such claim or cause of action arose or be forever barred. Any rights not expressly granted herein are reserved.
